Madonna's request to adopt a second child from Malawi. DENIED!!!

The singer's lawyer, Alan Chinula, confirmed that Madonna was not granted custody of 3-year-old Chifundo

Madonna, (who was not in court), can appeal to the Supreme Court if she feels that this was a best decision since she is now single.

The lawyer who saw the ruling, but where not associated with the case, told the Associated Press that Madonna was denied because of residency rules.

Malawi adoption regulations require that prospective parents live in the southern African nation for at least 18 months.

However, the residency rule was waived in 2006 when Madonna was allowed to take her adopted son, David Banda, to London before his adoption was finalized in 2008. So it's unclear why the judge in the case ruled differently this time.

There is speculation that it could have to do with Madonna being single again, having divorced Guy Ritchie last year. Which probably is the case? They feel that the ruling was against her because of the way the judge’s views of the material girl’s single way of living.

Malawi has close to 2 million orphans in need of help.

Madonna has been in Malawi with her three children -- 3-year-old David, 8-year-old son Rocco and 12-year-old Lourdes -- since last weekend. The singer, who filmed a documentary on the devastating poverty and AIDS crisis, is in the process of building a new school in the impoverished country.
